Terms of supply

This site (hereafter “the site”) is owned by Asiagem S.R.L. (hereafter Asiagem). Its registered office is at Via Maestri del lavoro n.1, Matino (Le), its fiscal code, company register number and VAT number is 04593030754.

Conclusion of contract and general terms of sale

1. If the customer is a consumer (i.e. an individual who buys goods not for business activities, that is to say he/she does not use a VAT number), contracts closed with Asiagem through the site are regulated by the Legislative Decree n. 206 of 06 September 2005. Asiagem also fulfils obligations described in the Legislative Decree n. 70 of 9 April 2003.

2. The contract between Asiagem and the customer is intended to be completed when the order sended by the customer - in accordance with the purchasing process - reaches the address of the site. The order will be binding for Asiagem just if the purchasing procedure is regularly completed and no error messages will show up on the site.

3. Sending the order to Asiagem, the customer acknowledges and declares that he/she has read all the indications provided during the purchasing process and that he/she accepts the general condition of sale (mandatory flag before the order completion).

Purchasing methods

1. The customer can just purchase the products available on the catalogue of the site at the moment of the order. The order cannot be completed for the products that are on the site, but are not available. Products on the site can be purchased until stocks are exhausted. Pictures in the products data sheets are for illustrative purpose only and could not match the real characteristics. They can differ in colour, dimensions and optional features.

2. Acceptance of the order will be confirmed by Asiagem through an email communication, sended to the address the customer has provided during the order. The confirmation note will include the identification number, the order date, the description of the purchased products, their price, the shipping costs, invoicing data, delivery data, payment method and a recap of the general conditions of sale. The customer has to check the content of the email and inform Asiagem about any possible mistake.

Payment options

1. Credit card. In case of payment with credit card, upon completion of online transaction, the issuing company will only authorize the withholding of the amount related to the purchase. The amount related to the ordered goods will be charged on the customer credit card once the invoice is issued.

2. In case of cancellation or ineffectiveness of the order Asiagem will ask the revocation of the authorization and the release of the withheld amount. For some credit cards, the release time exclusively depends on the bank system, and can reach the natural expiry time. Once the revocation of the authorization is done, Asiagem cannot be held responsible for any damage, direct or indirect, caused by the delay of the release of the withheld amount from the bank system.

3. In case the order of the customer is fulfilled in the days close to the expiry date of the authorization, Asiagem will anyway charge the amount on the credit card, even if in advance of the goods delivery, in order to avoid the expiry of the transaction authorization.

4. At no time of the procedure Asiagem will be able to know the data of the customer credit card. They will be provided through a secure connection directly to the site of the issuing company that controls the transaction. No Asiagem archive will keep these data. So under no circumstances Asiagem can be held responsible for any improper or fraudulent use of the credit card by third parties, through the payment for products purchased on the site.

5. Advance bank transfer. Payment with advance bank transfer is subject to the limits that are from time to time shown in the purchase procedure the customer has to follow to complete the order. In case of payment through bank transfer the goods will be delivered only once the amount will be received on the bank account of Asiagem. The customer has to arrange the bank transfer within three working days starting from the receipt of the confirmation email and the customer has to send a copy of the bank transfer to Asiagem to the address servizioclienti@alegio.it- - Payment with advance bank transfer is subject to the limits that are from time to time shown in the purchase procedure the customer has to follow to complete the order. In case of payment through bank transfer the goods will be delivered only once the amount will be received on the bank account of Asiagem. The customer has to arrange the bank transfer within three working days starting from the receipt of the confirmation email and the customer has to send a copy of the bank transfer to Asiagem to the address.

6. PayPal ®. . Payment with PayPal is subject to the limits that are from time to time shown in the purchase procedure the customer has to follow to complete the order. This method of payment includes the opening, by the customer, of a PayPal account and the acceptance of its regulation. Asiagem will only accept payments from customers who are registered on the Italian site of PayPal. The amount will be charged on the PayPal account of the customer after the confirmation of the order by ASIAGEM. Delivery will occur only after the amount of the purchase will be credited on the PayPal account of Asiagem.

Delivery methods and costs.

1. Upon order entry, the customer has to ask for an invoice, if needed. For the issue of the invoice will be used the data provided from the customer during the order. Invoices cannot be modified once they are issued. Asiagem will send the invoice by email to the holder of the order, according to article n. 14 of Presidential Decree n. 445/2000 and Legislative Decree 52/2004.

2. Delivery costs are charged to the customer for purchases of less than €50, as described in the communication of order receipt. Payment of goods will be done with the method chosen from the customer during the order. For purchases over €50, shipping costs are free. For those who purchase outside te Italian territory, chipping costs are always paid by the buyer as described in the communication of order receipt. Payment of goods will be done with the method chosen from the customer during the order.


3. Goods will be delivered to the customer, or someone who has been commissioned, to the address provided during the order. Goods can be delivered to the floor of the customer if parcels weigh up to 15 kilograms, unless otherwise specified in the confirmation of the order. At the moment of delivery the customer has to check that i) the number of parcels is the same specified on the delivery document; ii) the parcel is not damaged or wet. Any damage to packages or products has to be notified, specifying that the customer reserves the right of checking goods. Once signed the delivery documents, the customer cannot contest any characteristic of the parcel. In accordance with the current legislation any damage can be notified to Asiagem within 8 days from the receipt of goods. Any cost to enter a restricted traffic zone or use public property is not included.

4. Delivery date is approximate and the maximum term is thirty days. A telephone notice from the courier is not included. In case of absence of the customer, the courier will make another attempt or will contact the customer by phone to agree upon a new delivery within the next 24 hours. In case of a negative outcome, Asiagem will try to contact the customer to understand the reasons for the failed delivery. In case of a negative outcome, the order will be considered cancelled due to the impossibility of delivering goods. Asiagem will inform the customer by email. The amount paid by the customer will be returned with a deduction of the costs of the delivery attempts.

5. In case of unavailability of goods, even if temporary, Asiagem will inform the customer by email. The amount paid by the customer will be reimbursed as soon as possible, within thirty days from the date of the order.

Right of withdrawal -legal warranty

1. According to article n. 64 of Legislative Decree n.206/2005 if the customer is a consumer, (i.e. an individual who buys goods not for business activities, that is to say he/she does not use a VAT number) can cancel the order for any reason.

To cancel a contract, the customer has to send a written communication to Asiagem within fourteen days after goods have been received. This communication has to be sent by email or by post using the form you can find on our website. The letter has to be addressed to:

Once the withdrawal communication is received, Asiagem customer service will send an email to the customer with the address where goods can be returned and the new returning number, that has to be shown on the returning form, that has to be enclosed to the product. The customer has to ship the product duly packed in its original packaging, without damaging it or modifying it with labels and complete of every accessories it had when it had been delivered. Shipment costs for returning products are at customer charge. Products have to be returned through courier within fourteen days after the email communication to the customer of the delivery address and the number of return authorization. The shipment is under the customer's responsibility until it is delivered to Asiagem. Upon receipt of goods Asiagem will check the entirety of the goods and will reimburse the customer of the amount of the purchased product, deducting the returning costs. The reimbursement will take place within fourteen days from the withdrawal communication, except the case of failure of returning the product. Reimbursement will be done by bank transfer. In case of payment through credit card or Paypal by the customer, the reimbursement will be done according to the regulation of the service of the credit card or Paypal.

3. The right of withdrawal is valid only for complete products, it is not valid for part of products (e.g. accessories, software, etc.). The right of withdrawal is not valid for audiovisual products or for informatic software (also those enclosed to hardware material), or for customised products, that cannot be returned or can be easily damaged. The purchased product has to be returned intact, in its original packaging and with all of its parts (manuals, cables, etc.). No labels of tape can be used on the original packaging. In case of damage of the product during the shipment, Asiagem will inform the customer (within five days from the receipt of the product), so that he/she can contact the courier in order to ask for a reimbursement of the value of the product, if it is insured. Asiagem is not held responsible for damage, theft or loss of the returned products, in case they are not insured by the customer.

What to do in case of withdrawal:

  • Within 14 days from the receipt of goods, the customer has to send to Asiagem by post (to Asiagem Srl, via Maestri del lavoro n.1, 73046 Matino LE) the withdrawal form ( download form ) filled in every part, in which he/she declares the will to withdraw the contract. The withdrawal form can also be sent by email, within fourteen days after the receipt of goods, to servizioclienti@alegio.it.
  • Once the withdrawal communication is received, Asiagem customer service will send an email to the customer with the address where goods can be returned and the new returning number, that has to be shown on the returning form, that has to be enclosed to the product.
  • The customer has to ship the product duly packed in its original packaging, without damaging it or modifying it with labels and complete of every accessories it had when it had been delivered.
  • Shipment costs for returning products are at customer charge. We suggest to insure the product against theft, loss or damage during the shipment. If the product is not insured, Asiagem can charge the customer for any damage.
  • Products have to be returned through courier within fourteen days after the customer email communication of the delivery address and the number of return authorization. The shipment is under the customer's responsibility until it is delivered to Asiagem. Upon receipt of goods Asiagem will check the entirety of the goods and will reimburse the customer for the amount of the purchased product, deducting the returning costs. The reimbursement will take place within fourteen days from the withdrawal communication, except the case of failure of returning the product. Reimbursement will be done by bank transfer, to the account specified by the customer in the withdrawal form, or through credit card or Paypal, depending from the payment method used during the order. In case of damage of the product during the shipment, Asiagem will inform the customer (within five days from the receipt of the product), so that he/she can contact the courier in order to ask for a reimbursement of the value of the product, if it is insured.

The right of withdrawal is not valid in case of significant flaws of integrity of the product, that is to say i) lack of the external original packaging; ii) lack of accessories (manuals, cables, parts, etc.) ; iii) damage of the product not due to shipment; iv) unusual storage method. In case of loss of the withdrawal right, Asiagem will return the purchased product to the customer, charging him/her for the shipping costs.

5.Every product sold by Asiagem is covered by conventional warranty and for the customer who is a consumer (i.e. an individual who buys goods not for business activities, that is to say he/she does not use a VAT number) also from legal warranty for lack of conformity, as described in the articles n. 128 - 135 of the Legislative Decree n. 206/2005. To take advantage of warranty, the customer has to keep the invoice or the receipt of payment received by email in digital format and the warranty document, for those products that have it.

6. The legal warranty is valid in case of lack of conformity of products at the moment of the delivery of goods, that arises within two years from the date of delivery of the product. The lack of conformity has to be notified within two months from the date of detection, otherwise warranty will be no longer valid. Any action against the vendor expires within twenty six months from goods delivery. In case of lack of conformity, the customer is entitled to the restoration of the flaw, free of charge, by repairing or replacing the product, otherwise by reducing the price of the product or by canceling the contract according to the article n. 130 of the Legislative Decree n. 206/2005. Within two months from the detection of the flaw, or within the maximum term of twenty six months, the customer has to send by email to Asiagem, a duly filled form for lack of conformity, available on Asiagem website, in order to ask for the restoration of the flaw. Upon receiving the communication, Asiagem customer service will inform the customer about the returning procedure and returning number that has to be specified on the form, already forwarded, that has to be sent with the product. Asiagem will send a courier to collect the product, without any additional fee for the customer. If possible, the product has to be returned in its original package and compete of all its parts (manual, cables, etc.). No labels or tape can be used on the original packaging. Once checked the returned product, Asiagem will repair it or replace it and then ship it back to the customer, except as described in article n. 130 of Legislative Decree n. 296/2005. If, after the intervention of an authorised customer service, it is determined that the flaw is not due to a lack of conformity, according to articles n. 108 et seq. of Legislative Decree n. 206/2005, the customer will be charged for intervention costs, asked by the customer service, and any shipping costs covered by Asiagem. Any damage to the outer package has to be notified to the courier, by specifying on the delivery document that the customer reserves the right of checking goods. As per the current regulation, any damage during the shipment has to be notified to Asiagem within eight days from the receipt of goods.

7. At his/her discretion, the customer can use some extra services offered by Asiagem, according to the limits and methods specified from time to time.

Lack of conformity

Asiagem is responsible towards the customer/consumer (i.e. an individual who buys goods not for business activities, that is to say he/she does not use a VAT number) for any lack of conformity, as described in the articles n. 128 - 135 of the Legislative Decree n. 206/2005. The legal warranty is valid in case of lack of conformity of products at the moment of the delivery of goods, that arises within two years from the date of delivery of the product. The lack of conformity has to be notified within two months from the date of detection, otherwise warranty will be no longer valid. Any action against the vendor expires within twenty six months from goods delivery. Warranty is not valid in case of negligence during use or maintenance of the product, or connection to non-compliant electrical systems. Any damage to the outer package has to be notified to the courier, by specifying on the delivery document that the customer reserves the right of checking goods. As per the current regulation, any damage during the shipment has to be notified to Asiagem within eight days from the receipt of goods. In case of lack of conformity, the customer is entitled to the restoration of the flaw, free of charge, by repairing or replacing the product, otherwise by reducing the price of the product or by canceling the contract according to the article n. 130 of the Legislative Decree n. 206/2005.

What to do in case of lack of conformity:

  • Within two months from the detection of the flaw, or within the maximum term of twenty six months from the delivery of goods, the customer has to send the form, duly filled in any part ( download form ), to ask for the restoration of the flaw. The form can be sent by post to Asiagem srl, via Maestri del lavoro n. 1, 73046 Matino (Le), or by email to servizioclienti@alegio.it.
  • Upon receiving the communication, Asiagem customer service will inform the customer about the returning procedure and returning number that has to be specified on the form, already forwarded, that has to be sent with the product.
  • The customer has to ship the product duly packed, if possible in its original packaging, without damaging it or modifying it with labels and complete of every accessories it had when it had been delivered.

Asiagem will send a courier to collect the product, without any additional fee for the customer. Once checked the returned product, Asiagem will repair it or replace it and then ship it back to the customer, except as described in article n. 130 of Legislative Decree n. 296/2005. Asiagem will try to act as described above as quickly as possible, trying to cause as less discomfort as possible to the customer. In order to do so, Asiagem cooperates with the best shipping companies, that ensure great performance and speed.

Claims

Any claim of the customer can be notified by email to servizioclienti@alegio.it.

Responsibility for third auxiliaries

Asiagem is not held responsible for the work of any third auxiliary part that intervene during payment, delivery, or any operation related to the order of the product through the site.

Applicable law and place of jurisdiction.

The contract between Asiagem and the customer is regulated by the Italian jurisdiction, with the exception of the conflict rules. For any legal dispute between Asiagem and the customer/consumer, regarding the sales contract, the competence is of the court of the town of residence of the customer, if it is in Italy. In any other case, the competence is of the court of Lecce.
